The app
TraceGraph is a Windows and Mac app by Davide Padoan (publishing as DavPad) that analyzes, on your computer, the mail you connect. By downloading or using it you accept these terms. For personal data, the privacy policy applies.
Personal-use licence
We grant you a personal, non-exclusive, non-transferable and revocable licence to use the app on your own computers, for your own mail and for mail you are authorized to access. We do not sell you the app: we grant you the right to use it.
Uses that are not allowed
- Connecting other people's mailboxes without their permission.
- Using the app to break the law, other people's rights or the terms of the services you use.
- Copying, reselling, renting or distributing the app, or trying to obtain its source code, except where the law allows it.
- Using the app to get around the limits or security measures of mail services or of senders' sites.
Third-party services
The app connects to services that are not ours: Google (Gmail), Microsoft (Outlook.com), your mail provider and Have I Been Pwned. By using them you also accept their terms, and we are not responsible for them. Breach information comes from Have I Been Pwned, licensed under CC BY 4.0.
Beta version
The beta version is free and meant for people trying it before release. It may contain errors and may change or stop working without notice. Be careful not to entrust it with anything you cannot find elsewhere: the app reads your mail, it does not replace it.
Purchases and refunds
If the app or some features become paid, the purchase is made through the Microsoft Store or the App Store, and prices, payments, refunds and the right of withdrawal follow the rules of the store you use and the law. We do not handle payments directly.
Updates
We may publish updates to fix errors, improve the app or adapt it to third-party services. Updates come from the store you installed the app from; for the beta version, in the way indicated to those who test it.
Intellectual property
The app, its code, texts, the TraceGraph name and graphics belong to Davide Padoan or to their respective owners (for example open-licence fonts and Have I Been Pwned data). Your data and your emails remain yours: we acquire no rights over them.
What we do not guarantee
- The list of services is derived from the messages the app reads and may be incomplete or contain errors.
- Breach information comes from an external service (Have I Been Pwned) and is not under our control.
- Unsubscribing depends on the sender: the app sends the request but cannot force the sender to honor it. GDPR letters are general information, not legal advice.
Liability
The app is provided as is. To the extent permitted by law, we are not liable for damages arising from use of the app. This does not limit the rights the law, and in particular the Italian Consumer Code (Legislative Decree 206/2005), gives you as a consumer, nor liability that cannot be excluded by law (for example for wilful misconduct or gross negligence).
Account access
Access to your mail remains yours: you can revoke it at any time, as explained in the privacy policy.
Withdrawal and uninstalling
You can stop using the app at any time by uninstalling it; first remove the profiles from the app if you also want to withdraw the authorization given to Google (the one given to Microsoft is removed from your Microsoft account, account.microsoft.com). What stays on the computer is explained in the privacy policy. We may suspend or discontinue the app, and withdraw the licence if you use the app against these terms. The right of withdrawal for purchases follows the store's rules.
Changes to the terms
We may change these terms, for example when the app changes. The new version is on this page with the updated date; if you keep using the app after the change, the new version applies, without prejudice to the rights the law gives you.
Governing law and jurisdiction
These terms are governed by Italian law. For consumers, the courts of the consumer's place of residence or domicile remain competent, and the mandatory rules of the consumer's country remain valid.
